Oh. Rev. Code Chapter 5312In 2010, Ohio’s Planned Community Act became law, creating the first statutory framework applicable to non-condominium community associations in Ohio. As defined, a “planned community” is a community comprised of individual lots with a deed, common plan, or declaration that requires mandatory membership in an owners association, common property owned by the association, and/or an obligation to pay fees to support such an association or common property. In essence, it codifies for planned communities the consumer protection provisions enacted in the Condominium Act specific to the association and its owners after turnover from the developer. It does not, however, address many issues attributable to developers, particularly the disclosure requirements as included in the Condominium Act.
