Manufactured and Mobile Homes: Ohio Laws: Ohio Laws

Manufactured home" means a building unit that is fabricated in an off-site facility and constructed in conformance with the federal construction and safety standards in 24 CFR Part 3280 and that has a permanent tag affixed to it, as specified in 42 U.S.C.A. 5415, certifying compliance with all applicable federal construction and safety standards.

"Mobile home" means a unit that meets the federal standards, but does not have a a permanent tag affixed to it, as specified in 42 U.S.C.A. 5415, certifying compliance with all applicable federal construction and safety standards.

A mobile home that meets the statutory definition set forth in R.C. 4501.01(O) must be licensed as a motor vehicle. Issuance of the license is not affected by financial responsibility laws because they do not apply to mobile homes.

The Uniform Commercial Code includes a definition which consolidates the definitions of both “manufactured home” and “mobile home”. For purposes of creating a security interest under R.C. Chapter 1309, anything designed and sold to be a dwelling will be defined as a “manufactured home.”

Limitations of power of county zoning commissions regarding permanently sited manufactured homes.

The annual manufactured home tax. Allows owner to choose between being taxed under this section, or the manufactured or mobile home being taxed as real property under Ohio Revised Code Title 57.

As a motor vehicle, manufactured or mobile homes must be titled with a certificate of registration.

Prohibits transfer of a manufactured or mobile home without delivery of the title.

Remittance of illegally assessed taxes or late payment penalty.

Ohio Manufactured Homes Program

The Ohio Manufactured Homes Commission has been abolished as a separate entity, and is now subsumed under the Ohio Department of Commerce.
