Ohio School Law: School Records

Defines "public records" as records kept by any public office. Describes the process of requesting public records. Also enumerates many exemptions to the public records law. Police disciplinary records are public records.

Duties of state and local agencies maintaining personal information systems. The rights of the general public to inspect or copy personal information where that information is contained in a public record as defined in RC 149.43 is specifically preserved in RC 1347.08(E)(1).

Records of juvenile court proceedings subject to an order sealing the record must be expunged upon written request of a person whose record has been sealed and presentation of a copy of the order to seal the records. However, a board may maintain records regarding an adjudication of delinquency that was used as the basis for the child's permanent exclusion, regardless of a court order to seal the record.

The Family Educational Rights and Privacy Act (FERPA) applies only to student records. It restricts access to and mandates procedures for challenging and correcting information in such records.

FAMILY EDUCATIONAL RIGHTS AND PRIVACY

Student records that are covered by the FERPA are not subject to the privacy rules of HIPPA . Although a school district as such is not generally subject to the privacy rules, some school-based services, such as a school-based health center, may be required to comply with the privacy rules. To the extent a state law provides greater privacy protection than the HIPAA privacy rules, the state law continues to apply and is not preempted by HIPAA.

The privacy rules under the Health Insurance Portability and Accountability Act (HIPAA) may apply to restrict the use and disclosure of individually identifiable health information by a group health plan sponsored by a school district for the benefit of the district's employees.
