Whitehouse.gov 6/18/24 noncitizens must – as of June 17, 2024 – have resided in the United States for 10 or more years and be legally married to a U.S. citizen, while satisfying all applicable legal requirements. Those who are approved after DHS’s case-by-case assessment of their application will be afforded a three-year period to apply for permanent residency. They will be allowed to remain with their families in the United States and be eligible for work authorization for up to three years. This will apply to all married couples who are eligible. Also applies to the children of these couples.

Also, individuals, including DACA recipients and other Dreamers, who have earned a degree at an accredited U.S. institution of higher education in the United States, and who have received an offer of employment from a U.S. employer in a field related to their degree, to more quickly receive work visas.

A federal judge in Texas has frozen President Joe Biden’s attempt to offer a path to citizenship to hundreds of thousands of immigrants who are married to U.S. citizens and living in the United States illegally.

6/4/24. Under this order: Migrants who cross without authorization — absent exceptional circumstances — would not be eligible for asylum, and subject to expdited removal. The new rule raises the threshold to grant an asylum hearing based on a credible fear claim, that is when a migrant manifests fear of prosecution or torture in their native country or country of removal.
The restrictions will remain in place until 14 days after the seven-day average of illegal crossings drops below 1,500. The measures will go back into effect once the number reaches 2,500.

Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.

The US Supreme Court reiterated that 8 U.S.C. Sec. 1182(f) gives the President broad authority to exclude aliens from the US by Executive Order.

Vests executive powers in the President, makes him the commander in chief, and requires that the President “shall take Care that the Laws be faithfully executed.”

Several Quaker meetings filed suit in the federal court in Maryland to block the US Department of Homeland Security (DHS) from its abrupt shift in policy that enables federal immigration enforcement officials to enter houses of worship for their immigration enforcement actions. The policy is already sowing fear within migrant friendly congregations and has led to cancellations in worship services out of fear, the complaint states. The suit alleges that the Trump policy violates the First Amendment and other protections.
